Terms of Service
Definitions
The platform defines key terms including "Service" as seamless.ae (a cloud-based property management platform), "User" as registered individuals or entities including Landlords, Property Managers, and Tenants, "Content" as information and materials on the platform, and "Account" as the registered profile for access.
General Terms Overview
The agreement comprises these Terms of Use, along with the Privacy Policy and any other document referenced herein, as the complete contract. Users accessing or registering agree to comply with applicable laws, and the company reserves modification rights for terms.
User Eligibility
Users must be at least 18 years old to create accounts and use the platform. Registration requires accurate, current, and complete information with ongoing maintenance of account data.
Platform Maintenance
While the platform aims for continuous availability, it may undergo scheduled maintenance or unforeseen outages. The company reserves rights to modify, suspend, or discontinue services without notice.
Services
The platform offers comprehensive property management tools, including lease management, payment collection, record-keeping, and account management for landlords, property managers, and tenants.
Payment Processing
Payment methods include Visa and MasterCard debit/credit cards in AED. Users can make payments on a recurring basis, upon request, or when charged with pre-authorized consent. Third-party payment processor terms apply, and the company disclaims liability for any transaction processing errors or delays.
The platform maintains OFAC compliance and won't serve sanctioned countries. Users under 18 cannot access payment services. Data security measures are implemented but complete security isn't guaranteed.
Account Responsibilities and Security
Users must maintain confidentiality of their account credentials and report unauthorized access immediately to the company.
Upload Policy
Users may upload necessary documents and property information. Content must be lawful and relevant to the services provided by Seamless.ae. The company reserves removal rights for violating or inappropriate content.
License and Intellectual Property
The company grants a limited, non-exclusive, non-transferable, revocable license to use the platform. All content remains the exclusive property of Seamless.ae or licensors. Users cannot reproduce, distribute, or create derivative works without permission.
User Conduct
Users agree against misusing the platform through unauthorized access, data harvesting, or interference. Illegal or harmful activities violate terms, and the company reserves suspension/termination rights.
Termination of Services
The company reserves rights to suspend or terminate access to the platform at any time, with or without cause or notice. Users must cease platform use and delete content copies upon termination.
Limitation of Liability
The company won't be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use the platform. Direct damages liability caps at six months of subscription fees. Free users receive no damage liability protection.
Governing Law and Jurisdiction
Terms are governed by and construed in accordance with the laws of the UAE. Disputes fall under exclusive UAE court jurisdiction, with English versions controlling translations.
Force Majeure
The company isn't liable for failures from circumstances beyond its reasonable control, including but not limited to natural disasters, war, strikes, or disruptions in telecommunications or internet services.
Changes to Terms & Conditions
The company reserves modification rights, with changes effective upon posting on the platform.
Payment Confirmation
Email confirmation arrives from the payment processor after payment completion.
Refund Policy
Approved refunds process through the original payment method, with timing dependent on issuing bank processing.
Cancellation Policy
Cancellations are permitted within 24 hours of service or payment request, subject to seamless.ae's approval. Processing takes up to 45 days based on financial institution policies.
Privacy and Data Protection
The company collects and processes personal information per its Privacy Policy. Users consent to data collection for account management, payment processing, and service improvement.
Pricing and Description Accuracy
The platform works to ensure accurate pricing and descriptions, with confirmed checkout prices being binding.
Indemnity
Users agree to indemnify and hold harmless Seamless.ae, its affiliates, officers, directors, agents, and employees from any claims, damages, liabilities, or expenses arising from platform use, term violations, or third-party right infringements.
App-Specific License Details
Mobile app users receive a non-exclusive, non-transferable license to install and use the app on a compatible device, subject to term compliance with revocation rights for breaches.
